Revenge porn is classified as revealing or sexually explicit images or videos of a person posted on the internet, typically by a former sexual partner, without the consent of the subject and in order to cause them distress or embarrassment
In 2019, President Cyril Ramaphosa signed the Films and Publications Amendment Act that made revenge porn illegal in South Africa into law. “Any person found guilty of sharing explicit images without the person’s consent will face time behind bars or hefty fines” warns Bayanda Mdingi, a legal advisor at LAW FOR ALL. If the victim is unidentifiable in the content, the perpetrator could face two years in jail and/or pay a fine of up to R150 000. However, if the victim can be identified in any way, the perpetrator could spend four years in prison and/or pay up to R300 000.
Prince Kaybee’s tweet and public apology reads: “I cheated, I humiliated my girlfriend publicly. To the people I have disappointed, the businesses I represent, my girlfriend and my mother I profusely apologise from the bottom of my heart.”
In case you didn’t know, Kaybee has been dating radio presenter Zola Mhlongo for over a year now and they even appeared on the YouTube series ‘Defining Love’, opening up about their relationship. Although the focus on Prince Kaybee and his relationship was about his cheating and infidelity, Twitter users were concerned at Hazel’s actions and raised the fact that her actions can be seen as revenge porn, and punishable by law.
